Glitchless Fitness Liability & Consent Agreement

1. Acknowledgement of Risk

By accessing or using the Glitchless app (“the App”), you acknowledge and accept that participation in any physical, cognitive, or wellness-related activities—including but not limited to fitness exercises, mobility routines, mindfulness practices, or performance programs—carries inherent risks.

These may include (but are not limited to) muscle strain, fatigue, injury, stress, or other physical or psychological effects. You agree to take full responsibility for your participation and for monitoring your own health and safety at all times.

2. Medical Disclaimer

The Glitchless app and all related materials are for general information and educational purposes only. They are not intended as medical advice or as a substitute for professional healthcare assessment, diagnosis, or treatment.

You should consult a qualified healthcare professional before starting any exercise, rehabilitation, or mental wellbeing program, especially if you:

Have any known medical conditions, injuries, or disabilities
Take medication that may affect your ability to exercise safely
Have been advised to avoid physical activity

If you experience dizziness, pain, shortness of breath, or any discomfort, you must stop immediately and seek medical advice.

3. User Responsibility

By continuing to use Glitchless, you agree that:

You are voluntarily engaging in all activities at your own risk.
You are in good physical and mental condition and capable of safely participating.
You will use the App responsibly and follow all instructions provided.
You will not hold Glitchless Ltd., its directors, employees, or affiliates liable for any injury, loss, or damage arising from your use of the App.

4. Limitation of Liability

Nothing in this Agreement excludes or limits liability where it would be unlawful to do so under UK law, including liability for:

Death or personal injury caused by negligence
Fraud or fraudulent misrepresentation

Subject to the above, Glitchless Ltd. shall not be liable for:

Any indirect or consequential loss or damage
Any injury or harm resulting from improper use of the App or failure to follow instructions
Any reliance you place on information provided within the App that is not verified by a healthcare professional

Your use of Glitchless is entirely at your own risk.

5. Data Protection and Privacy

By using the App, you consent to the collection and processing of personal data—including fitness performance, reaction time metrics, and engagement data—in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

6. Governing Law

This Agreement and any dispute arising from it shall be governed by and construed in accordance with the laws of England, Scotland, Northern Ireland and Wales.

7. Electronic Consent

By checking the box or selecting “I Agree,” you confirm that:

You have read and understood this Fitness Liability & Consent Agreement.
You are at least 18 years old, or have obtained consent from a parent or guardian if under 18.
You voluntarily accept all terms and conditions set out herein.

Your digital acceptance is the equivalent of a signed written agreement under UK law.
